These Terms and Conditions form a client agreement between ‘You’ and ‘Your’, the client, visitor, or website user and Empowered Lactation Consulting, ABN 61261431168, also referred to as ‘Sarah Long’, ‘We’, ‘Us’, ‘Our’.

The information contained in this website is for general information purposes only. You need to make your own enquiries to determine if the information or products are appropriate for your intended use.

AMENDMENT OF TERMS

We reserve the right to change, modify, add or remove portions of these terms at any time. Please check these terms regularly prior to using our website to ensure you are aware of any changes. We will endeavour to highlight any significant or substantive changes to you where possible. If you choose to use our website then we will regard that use as conclusive evidence of your agreement and acceptance that these terms govern your and www.empoweredlc.com.aurights and obligations to each other.

COMPETITION AND CONSUMER ACT

You must be over 18 years of age to use this website and to purchase any goods or services.

For the purposes of Schedule 2 of the Australian Consumer Law, in particular Sections 51 to 53, 64 and 64A of Part 3-2, Division 1, Subdivision A of the Competition and Consumer Act 2010, www.empoweredlc.com.au’s liability for any breach of a term of this agreement is limited to: the supplying of the goods or services to you again; the replacement of the goods; or the payment of the cost of having the goods or services supplied to you again.

BOOKINGS

Our fee schedule is as per website displayed on the ‘Services’ page. By making a booking with Empowered Lactation Consulting, you are accepting these Terms and Conditions and Fee Schedule.

All clients with bookings will receive an appointment reminder via email 24 hours before their appointment time, which must be confirmed via email or SMS. In cases where confirmation has not been received, Empowered Lactation Consulting will reasonably endeavour to contact you to confirm your appointment and obtain pre-appointment documentation.

All consultations require a $20 booking deposit to secure their appointment time. The Booking deposit is non-refundable if you cancel your appointment within 24 hours of your appointment time. 
By booking your appointment you are accepting Empowered Lactation Services cancellation policy and Fee Schedule as outlined in these Terms and Conditions. 

FEE SCHEDULE AND PAYMENT

Please read the information about fees and charges the ‘Services’ page as per website prior to booking.

All bookings are made via Cliniko Software and all bookings incur a late cancellation fee. Payment for services can be made via cash or bank transfer, banking details are provided on invoice emailed post consultation.

Travel Charges – All in home consultations booked that require travel in excess of a 40 minutes one-way attract an additional travel fee negotiated by yourself and www.empoweredlc.com.au. Distance is determined from Wonthaggi, Victoria 3995 - our business start point. All travel that falls within 40 minutes from our start point is included in the service fee and no additional travel fees are charged.

CANCELLATION POLICY

24 hours’ notice is required to cancel or reschedule your appointment. If you cancel your booking within less than 24 hours, a $20 late cancellation fee will apply. Repeated late cancellations will require a full payment to be received before attending a rescheduled appointment. New appointment times are subject to availability.

If your appointment is cancelled by www.empoweredlc.com.au within 24 hours of your appointment time, no financial penalty will be incurred by you. If in the event your appointment is cancelled by www.empoweredlc.com.au and a deposit has been received, and no suitable replacement appointment can be arranged in a reasonable timeframe, your full deposit will be refunded. 

NO SHOW POLICY

A ‘No Show’ occurs in the event that Sarah Long from Empowered Lactation Consulting, www.empoweredlc.com.au, arrives at the designated appointment address at the appointment time and you are not there within 15 minutes of the appointment commencing.
In the event of a ‘no show’ all reasonable attempts will be made by www.empoweredlc.com.au to contact you and make an alternative appointment. If an alternative appointment is not made within 48 hours of the appointment time, 100% of the appointment fee plus any travel costs as outlined in these Terms and Conditions will be invoiced to you and payable within 7 days.

DELIVERY OF SERVICES & GOODS

www.empoweredlc.com.au business hours are Monday to Friday 9am – 5pm unless otherwise specified. Correspondence, phone calls and support outside of these hours are at the discretion of the Lactation Consultant. Our mission is to respond to messages 24 hours, 7 days per week and ASAP. This is not guaranteed and dependent on our other commitments. We will ensure your message is responded to within 24 hours.

Physical goods are delivered by Australia Post. Deliveries are processed promptly upon receipt of full payment. Delivery may take between 2 and 14 days, depending on the delivery option. Damaged or lost orders should be resolved with Australia Post directly and we are not responsible for goods that are damaged or lost in transit or not received. Replacement of damaged or lost items is made at the discretion of Empowered Lactation Consulting (www.empoweredlc.com.au).

BREAST PUMP HIRE

Our breast pumps hired out to clients by www.empoweredlc.com.au require a $50 bond. In the event a breast pump is damaged, lost or not returned to www.empoweredlc.com.au the bond will kept www.empoweredlc.com.au. The cost to hire breast pumps are cost per week stated on the ‘Services’ page on the website. Accessories required to use breast pumps full functions are to be purchased by the you, the client, at a cost to you due to hygiene standards and infection risks.

PRIVATE HEALTH FUNDS

If you have private health insurance, you are responsible for liaising directly with your private health fund to determine if you are eligible for private health benefits in respect of the services provided from www.empoweredlc.com.au.

RETURNS AND REFUNDS

www.empoweredlc.com.au handles returns and processes refunds in accordance with the Australian Consumer Protection legislation.

Should you wish to return your order, please notify us within 14 days of purchase with a valid reason for return. If we are unable to resolve your complaint or further assist you, we will process a refund upon timely receipt of the goods purchased. Products must be in original packaging and unused. Unopened goods will be refunded in full. Refunds will be processed promptly and payment made by the same method that you made payment. All refunds are made at the discretion of www.empoweredlc.com.au

JURISDICTION

This agreement and this website are subject to the laws of Victoria and Australia. If there is a dispute between you and mwww.empoweredlc.com.au that results in litigation then you must submit to the jurisdiction of the courts of Victoria.

YOUR PRIVACY

We use the information we collect about you to maximize the services that we provide to you. www.empoweredlc.com.au respects the privacy and confidentiality of the information provided by you and adheres to the Australian Privacy Principles.

You may change your details at any time by advising us in writing via email. All information we receive from our customers, is protected by our secure servers. All customer data collected is secured against unauthorized use or access. Credit card information is not stored by us on our servers.
